A domestic contract is a contract such as a marriage contract, cohabitation agreement (in the case of parties in a relationship), or a separation agreement that is a type of domestic contract made after parties separate. While you are not legally obligated to have a lawyer to make a domestic contract, it is always prudent to have your own lawyer give you legal advice in the negotiation, drafting and execution of any domestic contract.

Decision-making responsibility (formerly known as custody) is about who will make important decisions about the care of a child or children. A parent who has all the decision-making responsibility can make important decisions about a child’s health care, education, and religion. If the parents share decision-making responsibility, both parents must agree on important decisions that affect their child.

Pursuant to the Family Law Act, equalization is a property regime scheme afforded only to married spouses. Equalization, or equal division of net family property, calculates each spouse’s net family property (assets, debts, and liabilities)  at the date of marriage and at the date of separation. Upon calculating each spouse’s net family property, whichever spouse has the higher net family property will be required to pay one half the difference to the lower net family property spouse. In circumstances, the Court will also have the discretion to award an unequal division of net family property subject to satisfaction of several factors.
