Child support in Ontario is the right of the child. It is calculated pursuant to the Federal or Provincial Child Support Advisory Guidelines and the payor’s annual income for that subject year. It is usually paid by the non-custodial parent (“payor”) to the custodial parent (“recipient”) who receives it on behalf of the parties child(ren).
The Table amount is designed to be the baseline amount of support that will be paid to the recipient spouse to care for the child’s day to day needs, such as shelter and food. However, there may be additional special or extraordinary expenses (such as for private tutoring, daycare, or healthcare) that will be divided between the parents and added on top of the Table amount. These are called s.7 “special and extraordinary expenses.”
Reference is made to the Federal and Provincial Child Support Guidelines, which are codified in statute. These guidelines contain tables that identify the amount of child support to be paid based on the income on number of children that the payor has.
The Guideline child support is determined by taking a percentage of the payor’s gross income. The percentage taken depends on the number of children.
There may also be additional special or extraordinary expenses (such as for private tutoring, daycare, or healthcare) that will be divided between the parents and added on top of the Table amount. These are called s.7 “special and extraordinary expenses.”
Based upon the parent’s annual income, s.7 expenses are usually divided on a percentage basis pursuant to their proportionate earning capabilities. For instance, if the payor and recipient spouse earn $50,000.00 per annum, the s.7 expenses are split 50/50 proportionate to their salary.
Child support seeks to establish a fair standard of support for children that ensure that they benefit from the financial means of their parents. Child support is guided by the Child Support Guidelines but has many variables that must be taken into account before determining the appropriate amount to be paid.
