The divorce process in Ontario, step-by-step
In Ontario, a request for a divorce typically begins with the commencement of an Application for Divorce. It can also be included as requested relief in a General Application, however that process is not covered in this FAQ. For Divorce Applications, the party seeking a divorce must complete the Application and have it issued with the court. This will create a file number for your matter. Once this file number is assigned, you can now proceed to have your documents personally served (by a person other than yourself) on the opposing party; in this case your former spouse.
After the Application is served, the Respondent will have a period of time to respond. If the Respondent objects to the Application, they can file an Answer. If no answer is filed after the applicable time period has passed, and individual can proceed to “set down” the Divorce by swearing and filing an Affidavit for Divorce along with a Draft Divorce Order. Once these materials have been received by the court and accepted by a judge, the Divorce Order will be signed and mailed to the parties. Thereafter, you can attend court to obtain a certificate of divorce for the payment of a pre prescribed fee.
