At Lakhan Tram LLP, we endeavour to return your telephone calls or respond to your emails as quickly as possible. The goal is to have at least an acknowledgement of your communication in your hands within 24 hours (but often earlier) and a substantive response within 48 hours at the outside. There are many factors that influence how long your matter can take to resolve. No two cases are identical, however, some factors that influence the length of your proceeding include your cooperation in disclosing information and producing documents, the degree of hostility between you and the opposing party and the availability of court resources. During your initial consultation, we will discuss your particular situation and provide an estimate of the range of time anticipated to bring your matter to completion.

Disbursements are expenses for which the client is responsible for in addition to the lawyers fee. Disbursements may include long distance telephone calls, photocopying costs, or costs to deliver documents to the court or  opposing party. In some cases, hiring other people, such as health care professionals or financial professionals may be required to advance your matter. The fees for these individuals, also a form of disbursements are another form of disbursements, or expenses in addition to legal fees borne by the client.

The time and associated costs to resolve a lawsuit by contract, mediation, arbitration or court can vary. Factors which determine the time and associated fees include the following:

  • The opposing parties’ frankness and cooperation in disclosing information and producing documents;
  • Your frankness and cooperation in disclosing information and producing documents;
  • The need for valuations of property, businesses and pensions;
  • The need for interim applications to court;
  • The number of documents involved;
  • The degree of hostility between you and the opposing party;
  • The wait for an available court date (and the possibility that the court may be overbooked and your case postponed to a later date);
  • The availability of the opposing party or the party’s lawyer.

A domestic contract is a contract such as a marriage contract, cohabitation agreement (in the case of parties in a relationship), or a separation agreement that is a type of domestic contract made after parties separate. While you are not legally obligated to have a lawyer to make a domestic contract, it is always prudent to have your own lawyer give you legal advice in the negotiation, drafting and execution of any domestic contract.

 

Decision-making responsibility (formerly known as custody) is about who will make important decisions about the care of a child or children. A parent who has all the decision-making responsibility can make important decisions about a child’s health care, education, and religion. If the parents share decision-making responsibility, both parents must agree on important decisions that affect their child.

Pursuant to the Family Law Act, equalization is a property regime scheme afforded only to married spouses. Equalization, or equal division of net family property, calculates each spouse’s net family property (assets, debts, and liabilities)  at the date of marriage and at the date of separation. Upon calculating each spouse’s net family property, whichever spouse has the higher net family property will be required to pay one half the difference to the lower net family property spouse. In circumstances, the Court will also have the discretion to award an unequal division of net family property subject to satisfaction of several factors.

While the determination of what the “best” lawyer is can be unique to every individual, there are certain markers that we encourage people to seek out in a civil litigation lawyer:

  • Strong personal rapport – Litigation can be time consuming. It is best to go through the process with someone you feel comfortable working with on a personal level.
  • Trial experience – Often we receive inquiries from clients who are often “pushed to settle by their current lawyer.” While taking a matter to trial is not to be taken lightly, depending on your objectives, knowing upfront the breadth of litigation experience your lawyer has, can avoid unnecessary surprises later on.
  • Experience with Alternative Dispute Resolution (ADR) – Many civil litigation matters will resolve before ever seeing the trial floor.  This is achieved through the employment of effective strategy, and in many cases, the application of appropriate ADR methods such as negotiation, mediation or arbitration.

The Civil Litigation process begins with the exchange of pleadings (Statement of Claim, Statement of Defence, Counterclaim, Crossclaim, Third-party Claim).

Once pleadings are officially closed, the next step is the documentary discovery phase which is intended to disclose to the fullest extent a parties knowledge, information and belief of all documents that may be in their control, power and possession . This involves creating what is called an Affidavit of Documents. Once that is exchanged between the parties, the next step is called Examinations for Discoveries, which can be held orally or in writing.

Once Discoveries are complete, depending on the jurisdiction, mandatory mediation may be required to be conducted. If not, the case proceeds to the pre-trial conference and then, finally, trial.

Motions are interim reliefs that can be obtained by either party at any time in the litigation (subject to no preclusion in the Rules of Civil Procedure or an Order from the Court). The purpose of a Motion is to allow a party to obtain temporary and/or immediate relief in circumstances that require same. For instance, a Motion for interim preservation of property or a Motion to inspect real or personal property are some common Motions brought in a civil litigation proceeding.
