Spousal support is support paid by one spouse, to another, upon the breakdown of a relationship.  Both married and common law spouses may be entitled to support from their former partner.

Spousal support disputes often involve complex financial and legal considerations.

Courts may consider:

  • Length of the relationship
  • Financial interdependence
  • Roles and contributions made during the relationship
  • Childcare responsibilities
  • Income disparity
  • Economic disadvantage or economic hardship

We assist clients with both entitlement and quantum disputes while pursuing practical resolutions and strong litigation strategies where necessary.

Spousal Support is money paid by one spouse to the other after they separate or divorce. Spousal support entitlements may exist for both common law and married spouses.

Everything you need to know

How do I get spousal support?

There are a variety of factors that go into the determination of whether a married or common-law spouse is entitled to spousal support and how much support they should receive.  Some of these factors include but are not limited to, the roles and responsibilities assumed by the parties during the relationship, the income of the parties and length of the relationship itself.  As spousal support cases are often contentious, it is best to speak with an experienced family lawyer to properly evaluate the merits of your spousal support claim.

The Procedure in Calculation Spousal Support

How is spousal support calculated in Ontario?

As noted above, there are a variety of factors that go into the determination of whether a spouse is entitled to receive spousal support.  Once this determination has been made, commonly lawyers make reference to the Spousal Support Advisory Guidelines or SSAG to calculate the appropriate amount of spousal support to be paid.  The Guidelines are complex with numerous permutations and considerations including whether a payor is also paying child support, and whether the children are minors or adults.
