The Civil Litigation process begins with the exchange of pleadings (Statement of Claim, Statement of Defence, Counterclaim, Crossclaim, Third-party Claim).
Once pleadings are officially closed, the next step is the documentary discovery phase which is intended to disclose to the fullest extent a parties knowledge, information and belief of all documents that may be in their control, power and possession . This involves creating what is called an Affidavit of Documents. Once that is exchanged between the parties, the next step is called Examinations for Discoveries, which can be held orally or in writing.
Once Discoveries are complete, depending on the jurisdiction, mandatory mediation may be required to be conducted. If not, the case proceeds to the pre-trial conference and then, finally, trial.
Motions are interim reliefs that can be obtained by either party at any time in the litigation (subject to no preclusion in the Rules of Civil Procedure or an Order from the Court). The purpose of a Motion is to allow a party to obtain temporary and/or immediate relief in circumstances that require same. For instance, a Motion for interim preservation of property or a Motion to inspect real or personal property are some common Motions brought in a civil litigation proceeding.
